Authorize sponsorship of legislation related to Regional Housing Number Allocation (RHNA)
Statement of Issue:
Sponsor legislation introduced by Senator Tony Strickland related to a municipality's opportunity for
judicial review of RHNA as it relates to that entity.
Financial Impact:
Not applicable.
Recommended Action:
Authorize the sponsorship of legislation, to be introduced by Senator Tony Strickland, related to
RHNA.
Alternative Action(s):
Do not authorize and direct staff accordingly.
Analysis:
The City of Huntington Beach has been asked to sponsor legislation introduced by Senator Tony
Strickland which will provide cities an opportunity to appeal the RHNA share allocation set forth by a
Council of Governments or subregion. Currently, there is no mechanism in place to dispute or
question each city's allotted housing share numbers in court as assigned by such Board.
The City Attorney worked with Senator Strickland's office to draft language which will create the
ability for cities to challenge share allocation of RHNA numbers in court. Specifically, it is proposed to
add a new subsection to Government Code 65584.05(e)(1), which states as follows: "The final
determination in subparagraph (A) shall be subject to judicial review pursuant to Section 1094.5 of
the Code of Civil Procedure. For the purposes of subdivisions (e) and (t) of Section 1094.5 of the
Code of Civil Procedure, the court may exercise its independent judgment on the evidence."
This legislation is reflective of the City Council's ongoing objective to maintain local control and
ensure better transparency into the allocation process. In sponsoring this legislation, the City furthers
its goal of addressing the community's concerns about impacts of housing mandates. When

introduced by Senator Strickland, the Intergovernmental Relations Committee will monitor and
support the legislation.

Pursuant to CEQA Guidelines Section 15378(b)(5), administrative activities of governments that will
not result in direct or indirect physical changes in the environment do not constitute a project.

locally.
• Huntington Beach seeks a mechanism for cities to dispute allotted housing share. Language
