The APR is due to the California Department of Housing and Community Development (HCD) and Governor's Office of Land Use and Climate Innovation (LCI) by April 1 every year to provide data on the prior calendar year. City staff has prepared Huntington Beach's APR for calendar year 2025 for the City Council's consideration. Pursuant to Government Code Section 65913.4(4)(a), proposed housing developments are entitled to SB 35 streamlining (ministerial approval) if the City fails to submit the APR by the April 1 deadline for two consecutive years. Financial Impact: There is no financial impact to filing the APR. Recommended Action: Approve the 2025 Housing Element Annual Progress Report, and direct staff to submit the 2025 Housing Element APR to the California Department of Housing and Community Development and Governor's Office of Land Use and Climate Innovation (formerly the Office of Planning and Research). Alternative Action(s): Do not approve the 2025 Housing Element Progress Report, and direct staff accordingly. The APR lists entitlements received for housing projects, building permits issued, and associated affordability of the new units for the 2025 calendar year. In 2025, the City issued building permits for the construction of 59 market rate (above moderate income) housing units, 26 moderate income units, 37 low income units, and 22 very low income units. In 2025, the City issued permits to construct 87 Accessory Dwelling Units (ADU). ADU affordability is based on a HCD approved survey conducted by Southern California Association of Governments (SCAG) for use by SCAG jurisdictions. As such, ADUs contributed to meeting all of the very low and low income RHNA units produced in 2025. Staff has prepared the report utilizing the forms adopted by HCD in accordance with the California Code of Regulations. A copy of the report is provided as Attachment No. 1. Upon approval by City Council, staff would submit the APR to HCD and LCI, as required under Section 65400 of the California Government Code. Environmental Status: This Action is covered by the General Rule that the California Environmental Quality Act (CEQA) applies only to projects that have the potential for causing a significant effect on the environment (Section 15061.b.3 of the State CEQA Guidelines). It can be seen with certainty that there is no possibility that this activity will have a significant effect on the environment. Therefore, this activity is not subject to CEQA. Since 2001,we have successfully partnered with jurisdictions across the county to create housing and land-use policies that increase affordable housing opportunities for lower-income working families. The 2025 Annual Progress Report(APR), regarding Housing Element Implementation, reflects housing activity across several income categories; however,the reported production largely consists of units without deed restrictions. During the 2025 reporting year,the City reports Zero deed restricted affordable housing units. The city's APR reports that the only non deed restricted units were 0 Acutely Low-Income units, 13 Extremely Low-Income units, 9 Very Low-Income units, and 37 Low-Income units constructed without deed restrictions, in addition to 59 Above Moderate-Income units. While increased housing supply contributes to overall market activity, units produced without enforceable affordability restrictions do not guarantee long-term access for lower-income households and therefore may not meaningfully advance progress toward meeting RHNA obligations for these income categories. The distinction between market-rate production and deed-restricted affordable housing is critically important. Deed-restricted units ensure that housing remains affordable to income-qualified households over time,providing lasting community benefit and directly addressing housing cost burdens faced by lower-income residents. Without such restrictions, affordability levels may fluctuate with market conditions, limiting the extent to which reported production translates into stable, equitable housing opportunities consistent with State housing goals. In addition,the City currently remains without a certified 6th Cycle Housing Element, which further underscores the urgency of establishing a clear and compliant framework to guide housing production moving forward. Adoption and State certification of a compliant Housing Element is essential to ensuring that strong affordable housing policies, adequate sites, and implementation programs are in place to facilitate the development of deed-restricted affordable housing. Without an approved Housing Element,the City lacks a fully realized roadmap for meeting its RHNA obligations and advancing housing opportunities for lower-income households. We respectfully ensure that adopted policies meaningfully support the creation and implementation of affordable housing development throughout the remainder of the planning period. 1 As the City progresses further into the 6th Cycle Housing Element period,the need to prioritize strategies that facilitate deed-restricted affordable housing production becomes increasingly urgent. Annual Progress Reports serve not only as compliance documents, but as indicators of whether adopted Housing Element programs are successfully creating pathways for deeply affordable housing development. I am not surprised at our losses given the makeup of the courts in a one-party state and the reluctance of federal courts to wade into city-state controversies. I support the effort nonetheless as a high priority fight for principle and for our quality of life. I suggest filing a compliant Housing Element under protest, continuing to assert our position as correct. I also suggest that council members who are required to sign the finding or overriding interest under duress file their own challenges to this violation of their first amendment rights as individuals in federal court. It is one thing for the federal courts to ignore these rights if they are seen as the rights of a city against a state and another thing if they are seen as the rights of individual American citizens against a state government.
