review and Approval or Denial; and
B) Evaluate opportunities to update the zoning code for efficiency in the entitlement process.

Recommended Action:
A) Accept the lowest responsive and responsible bid submitted by Hardy & Harper, Inc.,
in the amount of$3,278,000; and
B) Authorize the Director of Public Works to approve change orders up to 10%
contingency in potential construction change orders; and
C) Authorize the Mayor and City Clerk to execute a construction contract with Hardy &
Harper, Inc. in a form approved by the City Attorney.

21. 26-229 Adopted Ordinance No. 4347, amending Section 14.16.190 of the
Huntington Beach Municipal Code relating to Protecting Cross
Connections -Approved for Introduction March 3, 2026, by a vote of

A) Adopt Ordinance No.4347,"An Ordinance of the City Council of the City of Huntington
Beach Amending Section 14.16.190 of the Huntington Beach Municipal Code relating to
Protecting Cross Connections."

administrator that already exist, recommendations on CUPss that might be
eliminated and a new fee structure/fee study and timeline to update the code and
come back with a report.

Sugar the Surfing Dog Day
Recommended Action:
Celebrate Sugar the Surfing Dog -a five time World Champion, five time Huntington
Beach Surf City Dog Champion,and a Surfers'Hall of Fame Inductee-and declare each
December 5th as"Sugar the Surfing Dog Day."

Subject: Transfer of Authority of CUPs and Variances
ISSUE STATEMENT
The Zoning Administrator, one person, has the Authority to approve CUP's and Variances. This is
not very common in other cities. Here in Huntington Beach,we have a 7 member citizen appointed
commission, the Planning Commission, that meets twice a month that can better serve this
purpose to the community and the city. Some CUP's and variances can have great effect to
neighborhoods and communities negatively;the review by the Planning Commission would serve
the city more efficiently and in better service to the City.Additionally, there may be opportunities
to update the zoning code for efficiency in the entitlement process.
RECOMMENDED ACTION
1.Withdraw authority as soon as possible of the Zoning Administrator from authorizing Conditional
Use Permits (CUP) and Variances.All CUP and Variances to go to the Planning Commission for
review and Approval or Denial.
2. Evaluate opportunities to update the zoning code for efficiency in the entitlement process.

City Council Members:
I'm perplexed that this item has been included in the Agenda. The change of authority from the
Zoning Administrator to Planning Commission is not explained with any detail. The benefits
and potential downsides are not explained. There is nothing more than a few short paragraphs
that this needed to be done as soon as possible.
What is the urgency? Has this been reviewed by the community development department?Has
this been analyzed by the City Manager? Is the position of the Zoning Administrator being
eliminated?
If you read the description of the Zoning Administrator's job, it appears this process is
efficient since meetings with applicants take place promptly; effectively using staff time and
applicant time during office hours.
This agenda item raises far more questions than answers; it should not be voted on without
significant additional information being provided to the City's residents. What's the rush?
