FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 25-027: 1. Conditional Use Permit No. 25-027 to permit the onsite sale, service, and consumption of alcohol (ABC Type 48 License) within an approved approximately 1,250 sq. ft. eating and drinking establishment in the Beach and Edinger Corridors Specific Plan (BECSP)zoning will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood because the proposed use is located within an existing commercial center with other similar uses. The sale, service, and consumption of alcohol provides an additional service to the community and surrounding regional area which will benefit and serve customers within the community and the surrounding regional area. The eating and drinking establishment is not anticipated to generate additional noise, traffic, or other impacts above existing conditions. The BECSP and General Plan land use designation anticipated eating and drinking establishment uses with alcohol service, sale and consumption in this area. The request for alcohol is an upgrade to an existing eating and drinking establishment use and will serve to augment the overall customer experience. Furthermore, the consumption of alcoholic beverages will be contained within the building's interior only and will not generate detrimental impacts onto surrounding properties. The nearest residential use is approximately 60 ft. to the east of the subject site and is buffered by the building, drive aisle, and block wall. The use will be required to comply with conditions of approval pertaining to alcohol service and operation to assure that any potential impacts to the surrounding properties are minimized. 2. The granting of Conditional Use Permit No. 25-027 to permit the onsite sale, service, and consumption of alcohol (ABC Type 48 License) within an approved approximately 1,250 sq. ft. eating and drinking establishment will not adversely affect the General Plan because it is consistent with the Land Use Element designation of M-sp (Mixed Use — Specific Plan Overlay) on the subject property. In addition, it is consistent with the following goals, policies, and objectives of the City's General Plan as follows: Land Use Element Goal LU-11:Commercial land uses provide goods and services to meet regional and local needs. Policy LU-11 (A): Encourage a variety of commercial uses that cater to local and regional demand to create an environment that meets resident needs and increases the capture of sales tax revenues. G:1RCAs\NOA\2026\06022026 CUP 25-027(Distractions) Attachment 1.1 Policy LU-13 (A): Encourage expansion of the range of goods and services provided to accommodate the needs of all residents and the market area. The request will expand the range of goods and services provided in the area by permitting the upgrade from the on-site sales, service and consumption of beer and wine only to full alcohol within an existing approximately 1,250 sq. ft. eating and drinking establishment. The use will operate in a safe manner for residents and customers from the surrounding area because the hours of operation and business functions will remain the same and be contained within the interior of the building. Conditions have been added to the request which limit the use and manner in which alcohol may be sold and consumed to ensure the proposed will be compatible with the surrounding neighborhood while providing a service that will meet the needs of the community and increase sales tax revenue. 3. The granting of Conditional Use Permit No. 25-027 to permit the onsite sale, service, and consumption of alcohol (ABC Type 48 License) within an approved approximately 1,250 sq. ft. eating and drinking establishment will comply with the Town Center Boulevard Segment of the BECSP, and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance (HBZSO) because the BECSP allows eating and drinking establishments with alcohol service subject to approval of a Conditional Use Permit. The General Plan land use designation and the BECSP anticipated restaurant uses with alcohol service, sale and consumption in this area. The request for alcohol is an upgrade to an existing eating and drinking establishment and will serve to augment the overall customer experience. The proposed use will comply with all building occupancy/exiting requirements. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 25-027: 1. The plans received and dated December 2, 2025, and narrative received and dated January 8, 2026, shall be the conceptually approved design. 2. The use shall comply with the following: a. The hours of operation shall be limited to: i. 12:00 PM to 12:00 AM, Sunday through Thursday ii. 12:00 PM to 2:00 AM, Friday and Saturday. b. The Police Department shall conduct a formal review of the business one year after approval of this CUP to verify compliance with all conditions of approval and performance standards. Based on the findings of this review, the City may require corrective actions, impose additional conditions, or initiate modification or revocation proceedings if warranted. (PD) c. Performance standards for this CUP shall be based on measurable increases in law enforcement, code enforcement, or emergency service activity reasonably attributable to the operation of the use. An increase of twenty-five percent (25%) or more in calls for service, DUI related incidents, nuisance violations, or similar enforcement activity over any twelve-month period may result in modification or revocation of the permit. (PD) d. All areas of the alcohol business that are accessible to patrons shall be illuminated such that the appearance and conduct of all people in the alcohol business are visible from inside the alcohol business. The front and rear parking lots and area of the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of all persons on or about the area. (PD) g. An employee of the alcohol business must monitor all areas where alcohol is served. (PD) h. Alcoholic drinks shall not be included in the price of admission. (PD) i. All alcohol shall remain within alcohol business premises. No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee. (PD) j. Service of alcoholic beverages for consumption off-site shall not be permitted. (PD) k. There shall be no requirement for patrons to purchase a minimum number of alcoholic drinks. (PD) I. Games or contests requiring or involving consumption of alcoholic beverages shall be prohibited. (PD) m. No reduced price or promotions of alcoholic beverages shall be allowed after7:00 p.m. (PD) n. Last call for drinks shall be no later than 15 minutes before closing. (PD) o. Each individual patron shall only be served one standard single-sized alcoholic beverage at a time after midnight. (PD) p. Consumption of alcoholic beverages by on-duty employees, including servers, bartenders, kitchen staff,management and supervisory personnel is not permitted. (PD) q. Mandatory Responsible Beverage Service(RBS)training and certification shall be required for new employees within 60 days of being hired and for existing employees every 12 months. Training shall be provided by ABC or an ABC approved RBS trainer and records of the training must be maintained on-site for review. (PD) r. All owners, employees, representatives, and agents must obey all federal, state, and local laws. In addition, all conditions of the Conditional Use Permit, Alcoholic Beverage Control License and any other regulations, provisions, or restrictions prescribed by an agency with jurisdiction over the premise are required as part of the CUP to be followed. (PD) s. No patrons shall be permitted to loiter within the vicinity of any entrances and exits at any time. Loitering is prohibited on or around the premises or the area under the control of the licensee. (PD) G:1RCAs1NOA\2026106022026 CUP 25-027(Distractions) Attachment 1.3 t. The establishment shall employ a video surveillance security system with a minimum of one month video library recorded to a DVR or Cloud based system. The camera's minimum requirements shall be: clear, color, digital and able to record in low light. The business shall ensure all public areas, entrances, exits, parking areas to the front and adjacent to the business are covered by video surveillance. Electronic copies of video must be made available to the Huntington Beach Police Department within 48 hours of request. Digital recordings shall be made available for viewing on-scene upon request by police personnel conducting investigations. You are required to have someone able to operate the system on duty during all business hours. (PD) u. There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. There shall be no window coverings or advertisements that reduce the visibility inside of the business. (PD) v. Signage, posters, and advertising with "Do Not Drink and Drive" shall be posted in the business. (PD) x. Signs shall be posted in a conspicuous space at the entrance/exit of the establishment which shall state, "NO ALCOHOLIC BEVERAGES BEYOND THIS POINT." (PD) y. Dancing and/or dance floor and/or live entertainment is prohibited. (Note: a new or amended Conditional Use Permit and an Entertainment Permit issued by the City is required for these additional activities). (PD) z. If approved to be open past midnight, there shall be a minimum of two identifiable security employees on the premises every Thursday, Friday, and Saturday from 8:00 pm to 2:30 amto control crowds, monitor customers and ensure doors remain closed. (PD) aa. The rear doors of the premises shall be kept closed at all times during the operation of the premises except in cases of emergency and to permit deliveries. Said door(s) not to consist solely of screen or ventilated security door and shall not be used as a means of access by patrons to and from the premises. (PD) 3. Prior to commencement of alcohol sale, service, and consumption under the Type 48 license, the applicant shall complete improvements to the establishment's restroom facilities to include a new door and individual stall privacy partitions, if current accessibility levels can be maintained, subject to Community Development Department review and approval of any required permits. (PC) 4. Prior to submittal of the building permits, zoning entitlement conditions of approval shall be printed verbatim on one of first three pages of all the working drawing sets used for issuance of building permits (architectural, structural, electrical, mechanical, and plumbing) and shall be referenced in the sheet index. The minimum font size utilized for printed text shall be 12- point. 5. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. Conditional Use Permit No. 25-027 shall become null and void unless exercised within two (2) years of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Community Development Department a minimum of 30 days prior to the expiration date. 7. The City Council reserves the right to revoke Conditional Use Permit No. 25-027 pursuant to a public hearing for revocation, if any violation of the conditions of approval, Huntington Beach Zoning and Subdivision Ordinance, or Municipal Code occurs. 8. The Development Services Departments (Community Development, Fire, and Public Works) shall be responsible for ensuring compliance with all applicable code requirements and conditions of approval. The Director of Community Development may approve minor amendments to plans and/or conditions of approval as appropriate based on changed circumstances, new information or other relevant factors. Any proposed plan/project revisions shall be called out on the plan sets submitted for building permits. Permits shall not be issued until the Development Services Departments have reviewed and approved the proposed changes for conformance with the intent of the City Council's action. If the proposed changes are of a substantial nature, an amendment to the original entitlement reviewed by the City Council may be required pursuant to the provisions of HBZSO Section 241.18. INDEMNIFICATION AND HOLD HARMLESS CONDITION: The owner of the property which is the subject of this project and the project applicant if different from the property owner, and each of their heirs, successors and assigns, shall defend, indemnify and hold harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or proceedings, liability cost, including attorney's fees and costs against the City or its agents, officers or employees, to attack, set aside, void or annul any approval of the City, including but not limited to any approval granted by the City Council, Planning Commission, or Design Review Board concerning this project. B. PLANNING COMMISSION MEETING AND RECOMMENDATION: On April 14, 2026, the Planning Commission held a public hearing on the project. During the meeting the Commissioners discussed the use, proximity to sensitive uses, and number of calls for police service. During this meeting, Keith Farrow, Assistant Superintendent for the Ocean View School District, spoke in opposition to this request citing concerns with potential negative safety impacts to students and adjacent residents. Prior to this meeting, a comment letter was received by the Ocean View School District citing the same concerns (Attachment 11). A motion was made by Commissioner Thienes and seconded by Commissioner Babineau to find the project categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301, Class 1, and approve Conditional Use Permit No. 25-027 with suggested findings and modified conditions of approval, by the following vote: Ayes: Clifford, Thienes, Babineau, Palmer Noes: Bush, McGee Absent: Goldberg Motion Approved C. APPEAL: On April 22, 2026, Councilman Williams appealed the project citing that the approval will be detrimental to the welfare of residents within the vicinity, particularly the children of Westmont Elementary School that walk past the establishment on their way to and from school, which is located within 600 feet of the drinking establishment. D. Additional information is summarized below. The business currently has a Type 42 license to serve beer and wine. The upgrade will allow the business to sell and serve distilled spirits in addition to beer and wine. Police Department input is important when considering CUP requests for alcohol. Their recommended conditions of approval are incorporated in Attachment No. 1 to address potential impacts of the proposed use. The Police Department service calls summary and the Department of Alcoholic Beverage Control (ABC) report are also provided in Attachment No. 12. The business currently has a Type 42 license to serve beer and wine. An upgrade to a Type 48 license requires approval of a CUP from the Zoning Administrator in the Beach and Edinger Corridors Specific Plan (BECSP). The upgrade will allow the business to sell and serve distilled spirits in addition to beer and wine. Zoning Administrator Action: The Zoning Administrator (ZA) held a public hearing on February 18, 2026, to consider the proposed CUP. The applicant was present to answer questions. There were no speakers in opposition to the request. Prior to the ZA meeting, a letter was received from the Ocean View School District(Attachment No. 8) requesting that Conditional Use Permit 25-027 be denied (or further conditioned) citing the following concerns: • The proximity of the eating/drinking establishment within 600 feet of the Ocean View School District's Westmont Elementary School property located at 8251 Heil Avenue, in Westminster. • The upgrade to an ABC Type 48 license will allow for alcohol sales for consumption off premises and result in further clustering of alcohol and smoke/vape sales near Westmont Elementary School. • The current hours of operation (noon to midnight) are during school hours with the primary path of travel to and from school passing by the establishment. The School District requested conditions to modify the hours of operation from 4:30 p.m. to midnight, Monday through Friday and restrict off-site sales to food delivery service only. In considering the request, the Zoning Administrator imposed conditions of approval recommended by the Police Department to address public safety concerns (Attachment No. 5). The concern regarding off-site consumption was already addressed by recommended conditions 2.i and 2.j, which prohibit service of alcohol for off-site consumption. Regarding amending the hours of operation, the applicant explained they wanted to maintain their current hours of operation from 12:00 PM to 12:00 AM, Sunday through Thursday, and 12:00 PM to 2:00 AM, Friday and Saturday. The applicant mentioned that imposing later opening hours was not an acceptable condition. As such, the current operating hours were left in place; however, the ZA imposed a condition 43 requiring formal review of the business by the Police Department one year after approval. Based on the review, the City may require corrective actions, impose additional conditions, or initiate revocation proceedings if warranted. Appeal: On February 28, 2026, the project was appealed by City Council Member Chad Williams citing that the approval will be detrimental to the welfare of residents within the vicinity; particularly the children of Westmont Elementary School that walk past the establishment on their way to and from school, which is located within 600 feet of the drinking establishment. In considering CUP requests involving alcohol sales and/or service, input is obtained from the Police Department in addition to ensuring compliance with the General Plan and HBZSO. The Police Department reviewed the request and determined that since 2020 there has been a documented decline in total calls for service and alcohol related DUI arrests at Distractions Lounge. In 2025, there were only two low-priority report calls for service and zero DUI arrests. In addition, of total calls for service the last two years (April 2024 - April 2026), only one call (classified as an inspection) occurred during school hours (7:30 a.m.) and no calls involved juveniles. As such, the Police Department did not make adverse findings associated with the request and recommended 26 conditions of approval to further ensure public and employee safety. The Police Department conditions have been incorporated into the suggested Conditions of Approval in Attachment No. 1 and establish performance standards for monitoring increases in calls for service, DUI arrests, nuisance violations, and other enforcement activities. The conditions also include a one-year review and potential corrective action if warranted. OVSD is concerned that the proposed intensification of the Alcohol Beverage Control (ABC) license from a Type 42 License to a Type 48 License for the Distraction Lounge Bikini Bar, located at 16612 Beach Boulevard, Suite C in Huntington Beach, will be detrimental to OVSD's property and the surrounding area by exacerbating the existing high crime rate and police service calls. The premises are located within 600 feet of the Ocean View School District's Westmont Elementary School located at 8251 Heil Avenue, Westminster, California. The Westmont Elementary School property and playgrounds extend to the intersection of Beach Boulevard and Heil Avenue. In California, ABC may deny new retail licenses for establishments within 600 feet of a school, public playground, or nonprofit youth facilities. While proximity alone isn't an automatic denial, licenses are often refused if the business is deemed to negatively impact the welfare and morals of the area. OVSD is concerned with the proposed intensification in ABC license type and the cumulative negative impact of clustering ABC Type 42 and 48 licenses near Westmont Elementary School. Distraction Lounge, described as a "bikini lounge" on its street sign, has an active ABC Type 42 license. A Type 42 license allows the sale for on-site consumption of beer and wine without the requirements of food service. The proposed change to an ABC Type 48 license will also allow sales for on-site consumption of distilled spirits, without food service. OVSD is concerned with the added sales of distilled spirits, creating a negative impact on the morals and welfare near the school. The hours of operation for Distraction Lounge are noon to midnight on weekdays. This is during school hours. Westmont Elementary School students walk to and from school along Beach Boulevard to Heil Avenue, and school bus routes pass by. The primary path of travel to and from school passes the Distraction Lounge establishment. Our concern is the direct and cumulative detrimental impact to the area if the city approves the request to intensify the Distraction Lounge permit from crime and the high number of police service calls. The planning commission staff presentation identified ten (10) businesses selling alcohol within a quarter mile of the Westmont Elementary school. The planning commissioners asked if this was an unusual number of alcohol sales near a school. Staff responded that they do not have that information. We have researched the ABC website and determined Westmont Elementary school is the only school that serves Huntington Beach to have three(3)ABC Type 42 and 48 licensed businesses within 1,500 feet (.25 of a mile.) Huntington Beach has 336 active ABC licenses. A majority(250) of the ABC licenses are Type 41 and 47. ABC Type 41 (126) is for a bona fide restaurant (eating place) serving beer and wine and Type 47 (124) is a bona fide restaurant serving beer, wine and distilled spirits. The other ABC licenses are for caterers (35), portable bars (10), and event permits (8). The rest are one or two permits for clubs, special on-sales, beer and wine on a boat, brewpub, instructional tasting, and beer manufacturing. This type of ABC license is for bars, taverns, and nightclubs and does not require the service of food. Nowhere else in the area are schools exposed to bars around the school. The intensification of the ABC license exacerbates this. The numerous police service calls to the area indicate there is an existing problem The staff reports for Distraction Lounge's application states this is an existing "eating and drinking" establishment. This is misinformation used to twist the true character of the bikini bar. The ABC Type Huntington Beach City Council May 31, 2026 Page 4 42 and 48 do not require the service of food and even the sale of packaged food. The proposed conditions of approval, Condition 2.d., encourages the business to provide prepackaged food or snacks for consumption as a measure to support responsible alcohol service to protect the health and safety of the public. Distraction Lounge is not required, as a condition of either ABC License or CUP 25-027,to provide any food. The letter of justification submitted by Alexander Lev Tambor("Applicant") states; "...the bar works with local restaurants nearby to provide meal service and also patrons to use food delivery services..." Planning Commissioner Palmer stated during the public hearing that she visited the site and talked to the surrounding businesses. She stated that the restaurants did not provide food to the Distraction Lounge. She also stated that there is a higher rate of incidences associated with alcohol sales in bars than restaurants that serve alcohol. Commissioner Palmer also stated that none of the other tenants would recommend Distraction Lounge to get an upgrade to its (ABC) license. "Every morning there are bodily fluids all over the parking lot" and "a lot of cacophony goes on from there". "A vacant spot next to that bar cannot find a tenant basically from what goes on in that parking lot and apparently the bar." She also concluded that there is a component of nuisance associated with this use. Planning Commissioner McGee asked about the police department's report and stated that at the time of April 14, 2026, Planning Commission meeting, Distraction Lounge had four (4) police service calls, drastically more than in 2025. He stated that two were sexual incidents and adding liquor would not make this better. The was a police service call on March 25, 2026, for a female employee being followed by a male patron. A disturbing the peace call on April 11. 2026. He concluded that the trend is not improving and adding alcohol (distilled spirits) would intensify behavior at a bar like this. The police department report initially provided to the planning commission included 28 police calls in the area of Distraction Lounge in the past three (3) years. During the meeting, the police department representative (a former detective) attempted to pare down the calls to only those directly caused by Distraction Lounge and not necessarily in the parking lot or DUI stops. The police department representative, when asked if this was a high crime area, stated; "That area gets a lot of calls for service." The finding for approval requires that the use will not be detrimental to the general welfare of persons working or residing in the vicinity. The ABC requires a finding that the use is not detrimental to the welfare and morals of the area. The justification for the proposed findings stated that the use will not be detrimental because it is located in a commercial center and will augment the overall customer experience. The use in a commercial center does not justify an intensification of its liquor license. Any augmentation to the overall customer experience is outweighed by the detrimental impact on the welfare and morals of the area and community. The proposed finding states that the intensification of the liquor license is justified because it will be a benefit and serve customers in the community and surrounding region. The consistency finding with the Huntington Beach Land Use Element, Goal LU-11 is for the increase in sales tax revenue. Any benefit of increased sales tax revenue is outweighed by exacerbation of the existing high number of police service calls. Huntington Beach City Council May 31, 2026 Page 5 The proposed finding also states that the adjacent single family residential is "buffered" from the use of the parking lot and the subdivision wall, so there will be no noise concerns. There is no buffering. The parking lot and drive aisle are immediately adjacent to their backyards. The misinformation in the staff reports that Distraction Lounge is an existing "eating and drinking" establishment that makes it sound like it is a restaurant that wants to serve distilled spirits. This is misleading to residents in the surrounding neighborhood. The conditional use permit includes conditions of approval. Condition 2.b. requires the police department to conduct a formal review of the business one year after the approval of the CUP. We request that the conditions require an annual review because incidents can increase rapidly as indicated by police service calls in 2026. An annual review will keep the business invested in reducing police calls. Condition 2.c. concerns performance standards based on measurable increases in law enforcement, code enforcement, or emergency service activity reasonably attributed to the operation of the use.The term "reasonably attributed" needs to be clarified. The proposed use has a cumulative impact to the area, such as DUI's, disturbing the peace, loitering in the parking lot, nuisance violations, theft, sex crimes, and traffic stops. The proposed condition establishes a threshold is 25% or more in calls in a 12-month period which may result in modification or revocation of the permit. In 2026, that threshold has already been met. It is unclear how incidents will be attributed to the bikini lounge and what legislative body will modify or revoke the permit. OVSD is concerned with the cumulative impact to the area that already has a lot of police service calls. A measurable increase in the area's service calls should also be included to determine the impact to the area of the intensification of the Distraction Lounge liquor license. We request that the condition be revised to clarify how service calls will be attributed and an analysis of police service calls to the area, how the permit modification and revocation will occur. We request that we receive notice of any permit modification or revocation of the conditional use permit. Condition 2.e. and f. concern lighting, as required by the ABC license. The condition does not establish a lighting standard that is to be met at the entrance and in the front and rear parking areas. The existing lighting appears very dim. The typical lighting standard is 1 foot candle. We request that the condition be revised to include a specific lighting standard, such as 1 foot candle. Condition 2.u. and v. concern no window coverings or advertisement that reduce the visibility inside the business. The shopping center windows have already been blocked. Attachment 2, Project Plans, indicates on Elevation 4 that wooden panels cover windows that are on other tenant spaces in the shopping center. The photographs below show that the tenant units typically have window fronts. In addition, the photograph shows the existing low level of lighting in front of the Distraction Lounge and the breezeway to the back parking lot. The condition of approval should be revised to require the removal of the wooden panels because they reduce visibility inside the business. Type 48 permit also requires a condition for drug testing kits to prevent drink spiking. The license also requires reporting of drink spiking to the ABC. A condition of approval should be added requiring drug testing kits and reporting of drink spiking to the Huntington Beach police department as well as the ABC, since type of incident may not result in a police service call. The planning commissioners asked about the history of the Distraction Lounge. The applicant stated that Distraction Lounge took over the existing ABC Type 42 license from a business called the Filling Station in 2012 and continued to operate the bar. Staff stated a use and occupancy permit is required when a business changes hands. The applicant applied for a certificate of occupancy permit on October 29, 2012. However, the application for a new use and occupancy permit indicates that the land use is a store with an occupancy group of M classification, defined as a facility that holds stocks of goods, wares or merchandise incidental to such purpose. Clearly, the Distraction Lounge is not a store. The city inspector granted a certificate of use and occupancy for R-3, R-3-1 and U Occupancies. U occupancy is for Utility and Miscellaneous occupancies. R occupancies are for residential. Bars and taverns are Assembly Group A-2. This appears to be misdirection as to the true character of the land use when the applicant filed for a use and occupancy permit. We were unable to find a Huntington Beach business license for Distraction Lounge. We also were unable to find a business entity on the California Secretary of State Portal. The applicant's representative stated during the planning commission hearing that the owner of Distraction Lounge recently incorporated the business after operating the business as a sole proprietorship. Possibly the business is incorporated in another state, Huntington Beach City Council May 31, 2026 Page 7 but that would be on the business license. A condition of approval should be added requiring the applicant to obtain a business license and obtain an appropriate certificate of use and occupancy that reflects the land use and complete area of occupancy. Found lying on the ground bleeding from the back of his head. Reported conscious and breathing. Second subject Male, White, 50s. Two males were involved in a physical altercation outside a bar. One male was knocked to the ground and struck his head. A bar manager reported a bouncer grabbed the subject and threw him to the floor, then left him there. The subject was found bleeding from the back of his head inside the bar. Medical units were requested and staged nearby before being cleared to enter. He said the subject was cut off from ordering alcoholic beverages at the bar because he had consumed too much, was acting belligerent towards the bartender, and was using profanity against her. The male subject was punched in the face by a transient and sustained dental injuries to his jaw. On DISTRACTIONS LOUNGE CFS Huntington Beach Police Department CFS Report today's date at approximately 0100 hours, subject went to Distractions Lounge located at and was assaulted by a male subject. He was outside of the location smoking a cigarette when a male subject, described as a male white or Hispanic, approximately in his mid to late 20' asked him for a cigarette. He told the subject he did not have a cigarette for him and the subject became angry. The victim turned away from the subject and in doing so the subject punched him once on the right side of this face with a closed fist. The victim did not fall to the ground nor did he lose consciousness. The subject fled the area in an unknown direction. The victim went home and felt his jaw was dislocated, so he went to HOB for medical assistance. The officer went to Distractions in an attempt to locate a crime scene and upon arrival the business was closed. A customer broke a Modelo beer sign with a pool cue, reportedly by accident, and initially refused to pay for the damage. He ultimately agreed to allow the bar to charge him $100 for the damages. He then left the location on foot. The current operation of this establishment routinely violates California state law and local zoning codes, proving that the business is a detriment to public welfare and the surrounding community. While Distractions Lounge operates as a standard bar under California Department of Alcoholic Beverage Control (ABC) rules, its staff routinely and flagrantly violate California ABC Rule 143 regarding attire and conduct for beverage servers. Specifically, I have witnessed the following severe violations: • Prohibited Breast Exposure: Multiple bartenders wear pasties that leave the entire breast exposed. Furthermore, at times staff wear sheer, completely translucent clothing that fully exposes their nipples and breasts. • Prohibited Buttocks Exposure: Employees who are actively serving beverages to customers are failing to cover their buttocks. They routinely wear outfits that leave their whole buttocks exposed, all the bottoms are always string bikinis which is a direct violation of state regulations governing food and beverage servers. • Illegal Lewd Conduct: Bartenders are purposely and overtly exposing their private anatomy to patrons in exchange for monetary tips. • Intoxicated staff: Bartenders are also permitted to consume alcohol while on shift which results in over serving of patrons and leads to many problems since they are too intoxicated to properly do their jobs. Under California ABC Rule 143.2, standard retail liquor licensees are strictly prohibited from permitting employees who serve beverages to expose their breasts or buttocks. Distractions Lounge is operating an illegal adult entertainment venue under the guise of a standard lounge. 1 This blatant lawlessness is completely unacceptable for an establishment operating in immediate proximity to Westmont Elementary School. The fact that the City Council was reportedly only provided a summary of 4 police calls for service—while previous Planning Commission records detailed 28 police calls from 2023 to 2026—suggests that the true operational impact of this venue is being downplayed. Distractions Lounge has demonstrated a complete disregard for state law, public decency, and its existing permit conditions. They cannot be trusted with an expanded, full-liquor Type 48 license.
