On August 18, 2026, City Council approved for introduction Ordinance No. 4351, which amends Chapter 13.08 of the Huntington Beach Municipal Code by clarifying definitions and permit requirements for commercial and organized activities on the beach and adjacent beach areas. Financial Impact: No funds are required to approve the proposed changes to either ordinance. Proposed changes to Ordinance No. 4350 are administrative in nature and will provide staff with the operational flexibility necessary to implement a modern parking payment system and improve operational efficiencies. Proposed changes to Ordinance No. 4351 clarify existing regulations and administrative procedures for permitting commercial and organized activities within the City's beach areas. Recommended Action: A) Adopt Ordinance No. 4350, "An Ordinance of the City Council of the City of Huntington Beach City of Huntington Beach Page 1 of 3 Printed on 8/26/2026 powered by LegistarT", 416 File #: 26-757 MEETING DATE: 9/1/2026 Amending Sections 10.04, 10.50, 10.56, 10.60, 10.64, and 10.68 of Title 10 of the Huntington Beach Municipal Code relating to Vehicles and Traffic." B) Adopt Ordinance No. 4351, "An Ordinance of the City Council of the City of Huntington Beach Amending Sections 13.08.005 and 13.08.080 of Chapter 13.08 of the Huntington Beach Municipal Code relating to Beach Regulations." Alternative Action(s): Do not approve the recommended actions and direct staff accordingly. Analysis: Ordinance No. 4350: The City's current Municipal Code requires that an individual parking meter be installed at each metered parking space and requires that coin payment be accepted. As parking technology has evolved, these requirements have become outdated and limit the City's ability to efficiently manage parking operations. The proposed amendments to certain sections of Chapter 10 remove the requirement for individual parking meters at every parking space, eliminate coin payment requirements, and authorize the use of mobile payment applications and strategically located multi-space pay stations as the primary methods of payment. In addition, the proposed updates will allow greater flexibility in how parking payment systems are deployed and operated. The proposed amendments would: • Remove the requirement that every metered parking space be served by an individual parking meter. • Eliminate coin payment as a required payment method. • Authorize the installation and operation of multi-space pay stations in appropriate locations throughout the metered parking zone. • Update Municipal Code language to provide greater operational flexibility and consistency. Transitioning to app-based payments with a limited number of pay stations will reduce the number of physical devices requiring maintenance, improve system reliability, and provide greater convenience for most users while continuing to accommodate customers who prefer not to use a mobile device through the availability of pay stations. Collectively, these amendments modernize the City's parking program by allowing the City to implement modern parking technologies while maintaining convenient payment options for users. The Community & Library Services Comm;ssion reviewed the proposed ordinance at its February 11, 2026, meeting and recommended City Council approve the proposed changes. Ordinance No. 4351: Separately, Chapter 13.08 regulates activities occurring on the beach and adjacent beach areas to protect public access, ensure visitor safety, preserve public resources, and provide for the orderly City of Huntington Beach Page 2 of 3 Printed on 8/26/2026 powered by LegistarT"" 417 File #: 26-757 MEETING DATE: 9/1/2026 use of City facilities. As commercial recreation and organized activities have evolved, staff have identified areas within the Municipal Code that would benefit from additional clarification. The proposed ordinance updates Chapter 13.08 by expanding the definition of"Facilities" to clearly identify the types of City-owned amenities subject to regulation, including bonfire rings, buildings, parking lots, picnic tables, barbecues, courts, and lifeguard towers. The ordinance also clarifies that any person who provides, offers, or advertises services; rents or furnishes equipment or personal property for commercial or promotional purposes; or conducts organized recreational, instructional, or fitness activities on the beach, adjacent beach area, or within the Water Activity Zone must first obtain written permission or a permit from the Director, as applicable. These amendments clarify existing regulations without making substantive changes to City policy. The revised language provides greater consistency in administration, ensures that all commercial and organized uses are reviewed through the established permitting process, and reduces ambiguity regarding activities that require City approval. The amendments also help protect public access, promote equitable use of public spaces, and support effective management of the City's beach resources. Environmental Status: Pursuant to CEQA Guidelines Section 15378(b)(5), administrative activities of governments that will not result in direct or indirect physical changes in the environment do not constitute a project. Section 10.04.055 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.04.055. Director of Community &Library Services. The Director of Community&Library Services shall be responsible for administering the on- street parking meter zones and the off-street City parking lots. SECTION 2. Section 10.04.086 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.04.086 Peak Season "Peak season" shall mean from 5:00 a.m. the Saturday before Memorial Day through 12:00 a.m. the day after Labor Day. SECTION 3. Section 10.04.090 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.04.090 Parking Meter "Parking meter" shall mean any single-space parking meter,multiple space parking meter,pay station, or any other equipment installed by the Director of Community &Library Services for the collection of payment to park in any designated metered parking space either in any off-street City pay parking lot or any on-street parking meter zone. SECTION 4. Section 10.04.115 of the Huntington Beach Municipal Code is hereby added to read as follows: 10.04.115 Payment "Payment" shall mean any method of remittance authorized or approved by the Director of Community and Library Services. SECTION 5. Section 10.50.020 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.50.020 Payment of Charges Required A. The City Council shall establish by Resolution the fees, rates and charges for vehicle parking at all off-street City pay parking lots. Collection of such fees,rates, and charges shall be made through authorized payment methods including mobile 1 ORDINANCE NO. 4350 payment applications, digital platforms, parking meters, attendants,or other City- approved systems. B. No person shall park or leave standing any vehicle upon any off-street City pay parking lot at any time without payment of the fees,rates and charges established for the use of the lot by Resolution of the City Council. C. All fees, rates and charges for parking at any off-street City pay parking lot shall be paid in advance in money of the United States of America, except as otherwise provided by validation agreement. D. No person shall park or leave standing any vehicle in violation of any properly noticed curfew as established by the City Manager or the Director of Community & Library Services. SECTION 6. Section 10.50.030 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.50.030 Validation Agreement- Authorization A. The City Manager or the Director of Community &Library Services may enter into written agreements with any person or legal entity to provide for validation of parking in any off-street City pay parking lot. B. The charges such person or legal entity pays shall be in accordance with the • schedule of fees, rates and charges for non-validated parking established by Resolution of the City Council. • • SECTION 7. Section 10.56.030 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.56.030 Parking Revenues from Metered Zones The City Treasurer may designate an employee to receive and account for all parking revenues. SECTION 8. Section 10.56.040 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.56.040 Parking Revenues Placed in Meter Fund It is the duty of the City Treasurer to account for and process all on-street parking meter zone money and to place it in a special fund to be known as the"parking meter fund,"which • fund shall be used exclusively for the purposes of specified in Section 10.50.060. • • • 26-17889/417592 ORDINANCE NO.4350 SECTION 9. Section 10.56.060 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.56.060 Use of Proceeds The money paid to parking meters in the on-street parking meter zones is levied and assessed as a fee to provide for the proper regulation,control and inspection of traffic upon the public streets,and to cover the cost of supervising, regulating and inspecting the parking of vehicles in the zones, the cost of placing and maintaining lines or markings,designating parking spaces in the zones, the cost of the purchase, supervision, protection, inspection, installation, operation, maintenance, control and use of the parking payment collection devices and/or payment instruction signs installed hereunder,and the acquisition by purchase or lease, improvement, operation, maintenance, repair and replacement of all parking facilities on streets; and the special fund in which such fees shall be placed shall be devoted exclusively to those purposes. SECTION 10. Section 10.56.080 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.56.080 Records of Violations. The Police Department shall maintain records of all violations of any provision of this Chapter occurring within designated on-street parking meter zones, including the date and time of each violation, the make and state license number of the vehicle involved,and any other information necessary to provide a complete understanding of the circumstances surrounding such violation. SECTION 11. Section 10.60.020 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.60.020 Times and Payment Deposited Prescribed. The parking time limits and fees for designated on-street parking meter zones shall be established as follows A. Business Zones. Parking spaces with 120-minute parking limits may be installed in the business zones, in locations determined by the Director of Community and Library Services. The fee for parking shall be three dollars per hour in off-peak season and four dollars per hour in peak season. Exceptions to these rates shall include July 4th, the two days immediately preceding and/or following July 4th as selected by the Director of Community and Library Services, and the three days of the Air Show when rates will increase by two dollars per hour. 1. Parking spaces with 24-minute parking limits may be installed in the business zone in locations determined by the Director of Community and Library Services. Parking in these parking locations will be limited to 5:00 a.m. to 12:00 a.m. daily, including Saturdays, Sundays, and holidays. 3 26-17889/417592 ORDINANCE NO. 4350 2. The Director of Community and Library Services may determine that certain business zone parking hours may be limited or extended. Notice of limited or extended parking limits shall be posted for the public. B. Residential Zones. 1. Parking spaces with 60-minute, 120-minute and 12-hour parking limits may be installed in the residential zones in locations determined by the Director of Community and Library Services. With the exception of Residential Zones (Section 10.60.010(B)(7) and (B)(8)), the fee for parking shall be three dollars per hour in off-peak season and four dollars per hour in peak season. The fee for parking in Residential Zones (Section 10.60.0I0(B)(7) and (B)(8)) shall be three dollars per hour in off-peak season and three dollars and fifty cents per hour in peak season. Exceptions to these rates shall include July 4th,the two days immediately preceding and/or following July 4th as selected by the Director of Community and Library Services and the three days of the Air Show when rates will increase by two dollars per hour. 2. Parking spaces with 60-minute, 120-minute,and 12-hour parking limits may be installed within the residential zone in locations to be determined by the Director of Community and Library Services. These parking locations will be limited to 5:00 a.m. through 12:00 a.m. daily, including Saturdays, Sundays, and holidays. C. Recreational Zones. 1. Parking spaces with 12-hour parking limits may be installed within Zones A, B, C, D and E in locations determined by the Director of Community and Library Services. The fee for parking shall be three dollars per hour in off- peak season and three dollars and fifty cents per hour in peak season. Exceptions to these rates shall include July 4th, the two days immediately preceding and/or following July 4th as selected by the Director of Community and Library Services and the three days of the Air Show when rates will increase by two dollars per hour. 2. Parking spaces with 30-minute,60-minute, 120-minute,and 12-hour parking limits may be installed within recreational zones in locations to be determined by the Director of Community and Library Services. These locations will be limited to parking from 5:00 a.m. through 12:00 a.m. daily, including Saturdays, Sundays, and holidays. 3. The Director of Community and Library Services may determine that certain recreational zone parking hours may be limited or extended. Notice of limited or extended parking limits shall be posted for the public. 4 26-17889/417592 ORDINANCE NO.4350 SECTION 12. Section 10.60.030 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.60.030 Varied Times Limits The Director of Community and Library Services or designee may designate the parking times allowed following payment as provided in this chapter. Parking payment devices or systems shall be configured to correspond to the designated time limits for each space. SECTION 13. Section 10.60.040 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.60.040 State Highways Within Zones The provisions of Chapters 10.56, 10.60, 10.64 and 10.68 of the Huntington Beach Municipal Code shall be ineffective as to any portion of a state highway within the boundary of the on-street parking meter zone as set forth in Section 10.60.030 six months after receipt of notification from the Department of Transportation of the State of California of its rescinding its approval to the ordinance codified in this chapter. SECTION 14. Section 10.60.050 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.60.050 Curfew In all on-street parking meter zones, the payment of fees through any authorized parking payment device or system does not exempt a person or vehicle from receiving a citation for violation of the posted curfew. SECTION 15. Section 10.64.010 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.64.010 Parking Payment When directed by the City Council, the Director of Community and Library Services shall cause to be installed on such streets or portions thereof within designated metered zones, parking payment devices or systems. SECTION 16. Section 10.64.020 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.64.020 Signs Indicating Payment Requirement The Department of Public Works shall install and maintain signs in the various areas within metered parking zones. The signs shall clearly indicate the type of parking payment device or payment system available and the days and hours during which payment is required. SECTION 17. Section 10.64.030 of the Huntington Beach Municipal Code are hereby amended to read as follows: 5 26-17889/417592 ORDINANCE NO. 4350 10.64.030 Sign Location Signs as referenced in Section 10.64.020 may be placed on separate posts, painted on curbs, displayed electronically,or otherwise provided in a reasonable manner to inform the public, at the discretion of the Department of Community and Library Services. SECTION 18. Section 10.64.040 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.64.040 Markings Indicating Parking Space The Department of Public Works shall have lines or markings painted or otherwise placed on curbs, streets, or adjacent areas to designate each parking space within designated metered zones and its applicable payment requirements. SECTION 19. Section 10.64.050 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.64.050 Vehicle Positions Within Lines Each vehicle parked in a designated parking space shall be positioned entirely within the lines or markings defining that space. SECTION 20. Section 10.64.070 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.64.070 Proper Functioning Parking payment devices or systems shall be designed to register payment for authorized parking time and provide a reasonable means of verifying that payment has been made, and the applicable parking time has not expired. Parking rates not specified in this Title shall be established by City Council resolution. SECTION 21. Section 10.64.080 of the Huntington Beach Municipal Code is hereby deleted in its entirety. SECTION 22. Section 10.68.010 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.68.010 Payment Required No person shall park any vehicle in any parking space (except as otherwise permitted in this chapter)without immediately making payment through an authorized parking payment device or system in the amount and for the time period required for that space. SECTION 23. Section 10.68.020 of the Huntington Beach Municipal Code is hereby amended to read as follows: 6 26-17589/417592 ORDINANCE NO.4350 10.68.020 Overtime Parking—On Street Parking Meter Zones No person, except as otherwise provided in this Chapter, shall cause, permit,allow or suffer any vehicle registered to or parked or operated by him or her to be or remain parked in any parking space in an on-street parking meter zone, designated by resolution of the City Council, beyond the time parking in such place is otherwise permitted or limited,or without paying the posted fee for the entire time the vehicle occupies the parking space. SECTION 24. Section 10.68.030 of the Huntington Beach Municipal Code is hereby deleted in its entirety. SECTION 25. Section 10.68.040 of the Huntington Beach Municipal Code is hereby deleted in its entirety. SECTION 26. Section 10.68.050 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.68.050 Payment Required --Exception A vehicle may be parked in a metered zone without payment during hours as authorized by City Council Resolution or Minute Action. SECTION 27. Section 10.68.060 of the Huntington Beach Municipal Code is hereby deleted in its entirety. SECTION 28. Section 10.68.070 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.68.070 Tampering with Signs,Payment Devices, or Meters. It is unlawful for any unauthorized person to open, or for any person to deface, injure, tamper with, or willfully break, destroy or impair the usefulness of any parking meter or sign, or to attempt to circumvent any authorized parking payment device or system,installed pursuant to this chapter, or to hitch any animals thereto. SECTION 29. Section 10.68.080 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.68.080 Parking Permits Notwithstanding any other provision of this Code, there is established a system of permit parking subject to the following standards and provisions: A. A non-transferable parking permit shall be issued upon payment of a fee established by resolution of the City Council and shall be valid for a period of one year. Such permit may be issued in the form of a physical decal or a virtual permit associated with a vehicle's license plate number. When a physical decal is issued, it shall be affixed to the inside of the front windshield of the permitted vehicle within a seven- inch square in the lower corner farthest removed from the driver's position. A virtual permit shall be valid only for the vehicle whose license plate number is registered 7 26-17889/417592 ORDINANCE NO.4350 with the City's parking permit system. A valid parking permit shall authorize the parking of the permitted vehicle in posted or metered zone areas within the City, as such areas have been or may hereafter be established by resolution of the City Council,without payment otherwise required for parking within such areas. Issuance of a parking permit shall not establish any priority or guarantee the availability of a parking space. B. Parking permits, whether issued as physical decals or virtual permits, shall be valid for one vehicle only and shall not be transferable to any other person or vehicle, except in the event that the vehicle for which the permit has been issued is replaced by a substitute vehicle. Physical decal permits may be transferred to a substitute vehicle by presenting the existing decal to the City and paying for any applicable fees. Virtual permits may be transferred to a substitute vehicle only after the permit holder officially notifies the City of the new vehicle's license plate number and the City acknowledges the change. C. The Director of Community and Library Services shall establish the rules and procedures for the sale and use of annual parking permits. SECTION 30. Section 10.68.130 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.68.130 Hours The hours of operation of said on-street meter parking zones shall be from 5:00 a.m. to midnight daily. SECTION 31. The City Treasurer may designate an employee to receive and account for all parking revenues. 10.56.040 Parking Revenues Coins Placed in Meter Fund. It is the duty of the Director of Finance City Treasurer to account for and process all on-street parking meter zone money and to deliver the money to the City Treasurer who shall place it in a special fund to be known as the "parking meter fund,"which shall be used exclusively for the purposes specified in Section 10.56.060 10.56.060 Use of Proceeds. The money paid to parking meters in the on-street parking meter zones is levied and assessed as a fee to provide for the proper regulation, control and inspection of traffic upon the public streets, and to cover the cost of supervising, regulating and inspecting the parking of vehicles in the zones, the cost of placing and maintaining lines or markings, designating parking spaces in the zones, the cost of the purchase, supervision,protection, inspection, installation, operation,maintenance, control and use of the parking payment collection devices and/or payment instruction signs meters installed hereunder, and the acquisitions by purchase or lease, improvement, operation, maintenance, repair and replacement of all parking facilities on streets; and the special fund in which such fees shall be devoted exclusively to those purposes. 10.56.080 Records of Violations The Police Chief shall keep an account of and report the number of each parking meter which indicates that the vehicle occupying the parking space adjacent to such parking meter is or has been parked in violation of any of the provisions of this chapter, the date and hour of such violation, the make and state license number of such vehicle, and any other facts a knowledge of which is necessary to a thorough understanding of the circumstances attending such violation. The Police Department shall maintain records of all violations of any provision of this chapter occurring within designated on-street parking meter zones, including the date and time of each violation, the make and state license number of the vehicle involved, and any other information necessary to provide a complete understanding of the circumstances surrounding such violation. 10.60.020 Times and Coins or Payment Deposited Prescribed. The parking time and fees will be affixed to the parking meters, as follows: The parking time limits and fees for designated on-street parking meter zones shall be established as follows: A. Business Zones. Parking spaces meters with 120-minute parking limits may be installed in the business zones, in locations determined by the Director of Community & Library Services. The fee for parking shall be three dollars per hour in off-peak season and four dollars per hour in peak season. Exceptions to those rates shall include July 4th, the two days immediately preceding and/or following July 4th as selected by the Director of Community & Library Services, and the three days of the Air Show when rates will increase by two dollars per hour. 1. Parking spaces meters with 24-minute limits may be installed in the business zone in locations determined by the Director of Community & Library Services. Parking in these parking locations will be limited to 56:00 a.m. to 12:00 a.m. daily, including Saturdays, Sundays and holidays. 2. The Director of Community & Library Services may determine that certain business recreational zone parking hours may be limited or extended. Notice of limited or extended parking limits shall be posted for the public. B. Residential Zones 1. Parking spaces meters with 60-minute, 120-minute and 12-hour parking limits may be installed in the residential zones in locations determined by the Director of Community and Library Services. With the exception of Residential Zones (Section 10.60.010(B)(7)and(B)(8)),the fee for parking shall be three dollars per hour in off-peak season and four dollars per hour in peak season. The fee for parking in Residential Zones (Section 10.60.010(B)(7) and (B)(8)) shall be three dollars per hour in off-peak season and three dollars and fifty cents per hour in peak season. Exceptions to these rates shall include July 4th, the two days immediately preceding and/or following July 4th as selected by the Director of Community and Library Services and the three days of the Air Show when rates will increase by two dollars per hour. 2. Parking spaces meters with 60-minute, 120-minute, and 12-hour parking limits may be installed within the residential zone in locations to be determined by the Director of Community and Library Services. These parking locations will be limited to 56 00 a.m. through 12:00 a.m. daily, including Saturdays, Sundays, and holidays. C. Recreational Zones 1. Parking spaces meters with 12-hour parking limits may be installed within Zones A, B, C, D and E in locations determined by the Director of Community and Library Services. The fee for parking shall be three dollars per hour in off-peak season and three dollars and fifty cents per hour in peak season. Exceptions to these rates shall include July 4th, the two days immediately preceding and/or following July 4th as selected by the Director of Community and Library Services and the three days of the Air Show when rates will increase by two dollars per hour. 2. Parking spaces meters or pay stations with 30-minute, 60-minute, 120- minute, and 12-hour parking limits may be installed within recreational zones in locations to be determined by the Director of Community and Library Services. These locations will be limited to parking from 56:00 a.m. through 12:00 a.m. daily, including Saturdays, Sundays, and holidays. 3. The Director of Community and Library Services may determine that certain recreational zone parking hours may be limited or extended. Notice of limited or extended parking limits shall be posted for the public. 10.60.030 Varied Meter Time Limits. When the City Council designates the parking times allowed following payment as provided in this chapter and more than one parking time is so designated, the Director of Community and Library Services may place the meters in such locations within the zone as he or she shall deem proper and consistent with the intention of the City Council. The Director of Community and Library Services or designee may designate the arkin• times allowed f•llowin• .a ment as rovided in this cha ter. Parkin a men •evices or s stems shall be confi ured to corres.and to the designated time limits for each space. 10.60.040 State Highways Within Zones. The provisions of Chapters 10.56, 10.60, 10.64 and 10.68 of the Huntington Beach Municipal Code shall be ineffective as to any portion of a state highway within the boundary of the on-street parking meter zone as set forth in Section 10.60.030 six months after receipt of notification from the Department of Transportation of the State of California of its rescinding its approval to the ordinance codified in this chapter. 10.60.050 Curfew. In all on-street parking meter zones, the payment of fees through any authorized parking payment device or system to a parking meter or pay station does not exempt a person or vehicle from receiving a citation for violation of the posted curfew. 10.64.010 Parking Payment Parking Meters When directed by the City Council, the Director of Community Services shall cause to be installed upon such streets or portions thereof within the on street parking meter zones, adjacent to each designated parking space, such parking meters as shall have been approved by the Council. When directed b�the City Council, the Director of Community and Library Services shall cause to be installed on such streets or portions thereof within designated metered zones, parking payment devices or systems. 10.64.020 Signs Indicating Payment Requirement Meter Type It is the duty of the Department of Public Works to maintain signs in the various areas within the parking meter zones, indicating the type of meter there installed and the days and hours during which the parking meters are in operation. The Department of Public Works shall install and maintain signs in the various areas within metered parking zones. The signs shall clearly indicate the type of parking payment device or payment system available and the days and hours during which payment is required. 10.64.030 Sign Location Signs as mentioned in Section 10.61.020, may either be on separate posts, painted on the curbs, or fastened to the parking meters, in the discretion of the Department of Public Works. Signs as referenced in Section 10.64.020 may be placed on separate posts, painted on curbs, displayed electronically, or otherwise provided in a reasonable manner to inform the public, at the discretion of the Department of Community and Library Services. 10.64.040 Markings Indicating Parking Meter Space. The Department of Public Works shall have lines or markings painted upon the curbs, streets or area adjacent to each parking meter, designating the parking space for which the meter is to be used. The Department of Public Works shall have lines or markings painted or otherwise placed on curbs, streets, or adjacent areas to designate each parking space within designated metered zones and its applicable payment requirements. 10.64.050 Vehicle Position Within Lines. Each vehicle parked adjacent to any parking meter shall be parked within said lines or markings. Each vehicle parked in a designated parking space shall be positioned entirely within the lines or markings defining that space. 10.64.070 Proper Functioning. Each parking meter shall be so designed that the deposit of a coin or coins will set the mechanism of the meter in motion or permit the mechanism to be set in motion so that the meter will show the unexpired parking time applicable to the parking space adjacent to the meter; and the meter, when parking time has expired, shall so indicate by a visible sign. Parking payment devices or systems shall be designed to register payment for authorized parking time and provide a reasonable means of verifying that payment has been made, and the applicable parking time has not expired. Parking rates not specified in this Title shall be established by City Council resolution. 10.64.080 Adjusting Meters. Parking meters when installed and properly operated shall be so adjusted to accept coins to show legal parking time. Rates will be determined by Council resolution. 10.68.010 Payment Coin Deposit Required. No person shall park any vehicle in any parking space (except as otherwise permitted in this chapter) without immediately making payment through an authorized parking payment device or system in the amount and for the time period required for that space. depositing in the parking meter adjacent, or centrally located, to said space such lawful coin or coins of the United States as are required by such meter and designated by directions on the meter, and when required by directions on the meter, setting in operation the timing mechanism thereof(if applicable), in accordance-with said directions, unless the parking meter indicates at the time such vehicle is parked that an unexpired portion remains of the period for which a coin or coins have-been previously deposited. 10.68.020 Overtime Parking—On-Street Parking Meter Zones Business Zones. No person, except as otherwise provided in this Cehapter, shall cause, permit, allow or suffer any vehicle registered to or parked or operated by him or her to be or remain parked in any parking space in an on-street parking meter zone, designated by resolution of the City Council as a business zone, during any time when the parking meter adjacent to such parking space indicates that no portion remains-of-the—period-4 time for which a coin or coins have been deposited, beyond the time parking in such place is otherwise permitted or limited, or without paying the posted fee for the entire time the vehicle occupies the parking space. 10.68.030 Overtime Parking Residential Zones No person, except as otherwise provided in this chapter, shall cause, permit or suffer any vehicle registered to or parked or operated by him or-her-to-be-Of-remain parked in any parking space in a parking meter zone, designated by-any resolution ofthe City Council as a residential zone, during any time when the parking meter adjacent to such parking space indicates that no portion remains of the period of time f r which coin or coins have been deposited, beyond the time parking in such place isotherwise permitted or limited, or without paying the posted fee. 10.68.040 Overtime Parking Recreational Zones No person, except as otherwise provided in this chapter, shall cause, permit, allow or suffer any vehicle registered to or parked or operated by him or-her-to-be-Of-remain parked in any parking space in a parking meter zone, designated by resolution of the City Council as a recreational zone, during any time when the parking meter adjacent to such parking space indicates that no portion remains of the period of time f r which coin or coins have been deposited, beyond the time parking-in such place is otherwise permitted or limited, or without paying the posted fee. 10.68.050 Payment Required Coin Deposit-- Exception A vehicle may be parked and remain parked in a parking meter-space-without-the deposit of any coin in the parking meter adjacent thereto during hours other tha those designated by resolution of the City Council as hours during which such deposits arc required. A vehicle may be parked in a metered zone without pa ment during hours as authorized by City Council Resolution or Minute Action. 10.68.060 Slugs It is unlawful to deposit or cause to be deposited in any parking meter any slug, device or metallic substitute for a one cent or a five cent or a 25 cent coin of the United States. 10.68.070 Tampering with Signs, Payment Devices, or Meters. It is unlawful for any unauthorized person to open, or for any person to deface, injure, tamper with, or willfully break, destroy or impair the usefulness of any parking meter or sign, or to attempt to circumvent any authorized parking payment device or system, installed pursuant to this chapter, or to hitch any animals thereto. 10.68.080 Parking Permits. Not withstanding any other provision of this Code, there is established a system of permit parking subject to the following standards and provision: A. A nontransferable parking permit shall be issued after payment of a fee, set by resolution of the City Council, to cover a calendar year. Such parking permit or decal, when affixed to the front windshield of a vehicle within a seven inch square in the lower corner farthest removed from the driver's position, shall authorize the parking of said vehicle in posted or metered recreational parking areas in the City, as such recreational parking areas have been, or may be hereinafter,established by resolution of the City Council, without the deposit of coins in a parking meter adjacent to a metered parking space. Such parking permit shall not, however, establish any priority for a parking space. A. A non-transferable parking permit shall be issued upon payment of a fee established by resolution of the City Council and shall be valid for a period of one year. Such permit may be issued in the form of a physical decal or a virtual permit associated with a vehicle's license plate number. When a physical decal is issued, it shall be affixed to the inside of the front windshield of the permitted vehicle within a seven-inch square in the lower corner farthest removed from the driver's position. A virtual permit shall be valid only for the vehicle whose license plate number is registered with the City's Harkin• •ermit s stem. A valid •arkin .ermit shall authorize the narkin e of the permitted vehicle in posted or metered zone areas within the City, as such areas have been or may hereafter be established by resolution of the City Council,without payment otherwise required for parking within such areas. Issuance of a parking permit shall not establish any priority or guarantee the availability of a parking space. B. Parking permits or decals shall be issued for one vehicle only and shall not be transferable to any other person or vehicle except in those eases where the vehicle for which the permit has been issued has been disposed of and a substitute vehicle acquired. Such permit shall be transferable to such substitute vehicle upon presentation of the old permit together with a transfer fee of one dollar. B Parking permits, whether issued as physical decals or virtual permits, shall be valid for one vehicle only and shall not be transferable to any other person or vehicle, except in the event that the vehicle for which the permit has been issued is replaced by a substitute vehicle. Physical decal permits may be transferred to a substitute vehicle bypresenting the existing decal to the City and paying for any applicable fees. Virtual permits may be transferred to a substitute vehicle only after the permit holder officially notifies the City of the new vehicle's license plate number and the City acknowledges the change. C. The Director of Community and Library Services shall establish the necessary procedure rules and .rocedures for the sale and use of annual parking .ermits. 10.68.130 Hours. The hours of operation of said on-street metered parking zones shall be from 5:00 a.m. to midnight daily. "Beach Parking Lot" means roads,driveways or parking area to service the Beach,Pier or Pier Plaza, excluding those areas located on a street or highway. "Pacific Ocean" includes all waters of the Pacific Ocean to a point three miles out from the mean high tide line, parallel to the three miles out from the Beach whether or not the lands lying under said tidal waters are privately owned or publicly owned, including, but not limited to,the Water Activity Zone. "Person" means any individual, firm, copartnership, joint venture, association, social club, fraternal organization, corporation or any other group or combination, acting as a unit. "Pier" means the appurtenance beginning at the intersection of Pacific Coast Highway and Main Street on the Beach, which is a platform extending into the Pacific Ocean and supported by piles or pillars. "Pier Plaza" means the developed area on the Beach immediately north and south adjacent to the Pier bounded by Pacific Coast Highway and the Beach Parking Lots adjacent thereto. "Smoke" or "smoking" means the carrying or holding of a lighted pipe, cigar, cigarette, e-cigarette, or any other lighted smoking product or equipment used to burn any tobacco products, weed, plant, or any other combustible substance. Smoking includes emitting or exhaling the fumes of any pipe, cigar, cigarette, e-cigarette or any other lighted smoking equipment used for burning or vaporizing any tobacco or nicotine product,weed, plant, or any other combustible substance. "Water Activity Zone" means the area that extends 1,000 feet seaward into the Pacific Ocean from the mean high tide line. Transitioning to app-based payments with a limited number of pay stations will reduce the number of physical devices requiring maintenance, improve system reliability, and provide greater convenience for most users while continuing to accommodate customers who prefer not to use a mobile device through the availability of pay stations. Collectively, these amendments modernize the City's parking program by allowing the City to implement modern parking technologies while maintaining convenient payment options for users. The Community & Library Services Commission reviewed the proposed ordinance at its February 11, 2026, meeting and recommended City Council approve the proposed changes. Section 10.04.055 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.04.055. Director of Community &Library Services. The Director of Community&Library Services shall be responsible for administering the on- street parking meter zones and the off-street City parking lots. SECTION 2. Section 10.04.086 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.04.086 Peak Season "Peak season" shall mean from 5:00 a.m. the Saturday before Memorial Day through 12:00 a.m. the day after Labor Day. SECTION 4. Section 10.04.115 of the Huntington Beach Municipal Code is hereby added to read as follows: 10.04.115 Payment "Payment" shall mean any method of remittance authorized or approved by the Director of Community and Library Services. SECTION 5. Section 10.50.020 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.50.020 Payment of Charges Required A. The City Council shall establish by Resolution the fees, rates and charges for vehicle parking at all off-street City pay parking lots. D. No person shall park or leave standing any vehicle in violation of any properly noticed curfew as established by the City Manager or the Director of Community & Library Services. SECTION 6. Section 10.50.030 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.50.030 Validation Agreement-Authorization A. The City Manager or the Director of Community & Library Services may enter into written agreements with any person or legal entity to provide for validation of parking in any off-street City pay parking lot. B. The charges such person or legal entity pays shall be in accordance with the schedule of fees, rates and charges for non-validated parking established by Resolution of the City Council. SECTION 7. Section 10.56.030 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.56.030 Parking Revenues from Metered Zones The City Treasurer may designate an employee to receive and account for all parking revenues. SECTION 8. Section 10.56.040 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.56.040 Parking Revenues Placed in Meter Fund It is the duty of the City Treasurer to account for and process all on-street parking meter zone money and to place it in a special fund to be known as the"parking meter fund,"which fund shall be used exclusively for the purposes of specified in Section 10.50.060. 2 26-17889/417592 420 ORDINANCE NO. 4350 SECTION 9. Section 10.56.060 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.56.060 Use of Proceeds The money paid to parking meters in the on-street parking meter zones is levied and assessed as a fee to provide for the proper regulation, control and inspection of traffic upon the public streets, and to cover the cost of supervising, regulating and inspecting the parking of vehicles in the zones,the cost of placing and maintaining lines or markings, designating parking spaces in the zones,the cost of the purchase, supervision,protection, inspection, installation, operation,maintenance, control and use of the parking payment collection devices and/or payment instruction signs installed hereunder, and the acquisition by purchase or lease, improvement, operation, maintenance, repair and replacement of all parking facilities on streets; and the special fund in which such fees shall be placed shall be devoted exclusively to those purposes. SECTION 10. Section 10.56.080 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.56.080 Records of Violations. The Police Department shall maintain records of all violations of any provision of this Chapter occurring within designated on-street parking meter zones, including the date and time of each violation, the make and state license number of the vehicle involved, and any other information necessary to provide a complete understanding of the circumstances surrounding such violation. SECTION 11. Section 10.60.020 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.60.020 Times and Payment Deposited Prescribed. The parking time limits and fees for designated on-street parking meter zones shall be established as follows A. Business Zones. Parking spaces with 120-minute parking limits may be installed in the business zones, in locations determined by the Director of Community and Library Services. The fee for parking shall be three dollars per hour in off-peak season and four dollars per hour in peak season. Exceptions to these rates shall include July 4th, the two days immediately preceding and/or following July 4th as selected by the Director of Community and Library Services, and the three days of the Air Show when rates will increase by two dollars per hour. 1. Parking spaces with 24-minute parking limits may be installed in the business zone in locations determined by the Director of Community and Library Services. Parking in these parking locations will be limited to 5:00 a.m. to 12:00 a.m. daily, including Saturdays, Sundays, and holidays. 3 26-17889/417592 421 ORDINANCE NO.4350 2. The Director of Community and Library Services may determine that certain business zone parking hours may be limited or extended. Notice of limited or extended parking limits shall be posted for the public. B. Residential Zones. Parking spaces with 60-minute, 120-minute and 12-hour parking limits may be installed in the residential zones in locations determined by the Director of Community and Library Services. With the exception of Residential Zones (Section 10.60.010(B)(7) and (B)(8)), the fee for parking shall be three dollars per hour in off-peak season and four dollars per hour in peak season. The fee for parking in Residential Zones (Section 10.60.010(B)(7) and (B)(8)) shall be three dollars per hour in off-peak season and three dollars and fifty cents per hour in peak season. Exceptions to these rates shall include July 4th,the two days immediately preceding and/or following July 4th as selected by the Director of Community and Library Services and the three days of the Air Show when rates will increase by two dollars per hour. 2. Parking spaces with 60-minute, 120-minute,and 12-hour parking limits may be installed within the residential zone in locations to be determined by the Director of Community and Library Services. These parking locations will be limited to 5:00 a.m, through 12:00 a.m. daily, including Saturdays, Sundays, and holidays. C. Recreational Zones. 1. Parking spaces with 12-hour parking limits may be installed within Zones A, B, C, D and E in locations determined by the Director of Community and Library Services. The fee for parking shall be three dollars per hour in off- peak season and three dollars and fifty cents per hour in peak season. Exceptions to these rates shall include July 4th,the two days immediately preceding and/or following July 4th as selected by the Director of Community and Library Services and the three days of the Air Show when rates will increase by two dollars per hour. 2. Parking spaces with 30-minute,60-minute, 120-minute,and 12-hour parking limits may be installed within recreational zones in locations to be determined by the Director of Community and Library Services. These locations will be limited to parking from 5:00 a.m. through 12:00 a.m. daily, including Saturdays, Sundays, and holidays. 3. The Director of Community and Library Services may determine that certain recreational zone parking hours may be limited or extended. Parking payment devices or systems shall be configured to correspond to the designated time limits for each space. SECTION 13. Section 10.60.040 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.60.040 State Highways Within Zones The provisions of Chapters 10.56, 10.60, 10.64 and 10.68 of the Huntington Beach Municipal Code shall be ineffective as to any portion of a state highway within the boundary of the on-street parking meter zone as set forth in Section 10.60.030 six months after receipt of notification from the Department of Transportation of the State of California of its rescinding its approval to the ordinance codified in this chapter. SECTION 14. Section 10.60.050 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.60.050 Curfew In all on-street parking meter zones, the payment of fees through any authorized parking payment device or system does not exempt a person or vehicle from receiving a citation for violation of the posted curfew. SECTION 15. Section 10.64.010 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.64.010 Parking Payment When directed by the City Council, the Director of Community and Library Services shall cause to be installed on such streets or portions thereof within designated metered zones, parking payment devices or systems. SECTION 16. Section 10.64.020 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.64.020 Signs Indicating Payment Requirement The Department of Public Works shall install and maintain signs in the various areas within metered parking zones. The signs shall clearly indicate the type of parking payment device or payment system available and the days and hours during which payment is required. SECTION 17. Section 10.64.050 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.64.050 Vehicle Positions Within Lines Each vehicle parked in a designated parking space shall be positioned entirely within the lines or markings defining that space. SECTION 20. Section 10.64.070 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.64.070 Proper Functioning Parking payment devices or systems shall be designed to register payment for authorized parking time and provide a reasonable means of verifying that payment has been made, and the applicable parking time has not expired. Parking rates not specified in this Title shall be established by City Council resolution. SECTION 21. Section 10.64.080 of the Huntington Beach Municipal Code is hereby deleted in its entirety. SECTION 22. Section 10.68.010 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.68.010 Payment Required No person shall park any vehicle in any parking space (except as otherwise permitted in this chapter)without immediately making payment through an authorized parking payment device or system in the amount and for the time period required for that space. SECTION 23. Section 10.68.020 of the Huntington Beach Municipal Code is hereby amended to read as follows: 6 26-17889/417592 424 ORDINANCE NO.4350 10.68.020 Overtime Parking— On Street Parking Meter Zones No person, except as otherwise provided in this Chapter, shall cause, permit, allow or suffer any vehicle registered to or parked or operated by him or her to be or remain parked in any parking space in an on-street parking meter zone,designated by resolution of the City Council, beyond the time parking in such place is otherwise permitted or limited, or without paying the posted fee for the entire time the vehicle occupies the parking space. SECTION 24. Section 10.68.030 of the Huntington Beach Municipal Code is hereby deleted in its entirety. SECTION 25. Section 10.68.040 of the Huntington Beach Municipal Code is hereby deleted in its entirety. SECTION 26. Section 10.68.050 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.68.050 Payment Required --Exception A vehicle may be parked in a metered zone without payment during hours as authorized by City Council Resolution or Minute Action. SECTION 27. Section 10.68.060 of the Huntington Beach Municipal Code is hereby deleted in its entirety. SECTION 28. Section 10.68.070 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.68.070 Tampering with Signs, Payment Devices, or Meters. It is unlawful for any unauthorized person to open, or for any person to deface, injure, tamper with, or willfully break, destroy or impair the usefulness of any parking meter or sign, or to attempt to circumvent any authorized parking payment device or system,installed pursuant to this chapter, or to hitch any animals thereto. SECTION 29. Section 10.68.080 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.68.080 Parking Permits Notwithstanding any other provision of this Code, there is established a system of permit parking subject to the following standards and provisions: A. A non-transferable parking permit shall be issued upon payment of a fee established by resolution of the City Council and shall be valid for a period of one year. Such permit may be issued in the form of a physical decal or a virtual permit associated with a vehicle's license plate number. When a physical decal is issued, it shall be affixed to the inside of the front windshield of the permitted vehicle within a seven- inch square in the lower corner farthest removed from the driver's position. Parking permits, whether issued as physical decals or virtual permits, shall be valid for one vehicle only and shall not be transferable to any other person or vehicle, except in the event that the vehicle for which the permit has been issued is replaced by a substitute vehicle. Physical decal permits may be transferred to a substitute vehicle by presenting the existing decal to the City and paying for any applicable fees. Virtual permits may be transferred to a substitute vehicle only after the permit holder officially notifies the City of the new vehicle's license plate number and the City acknowledges the change. C. The Director of Community and Library Services shall establish the rules and procedures for the sale and use of annual parking permits. SECTION 30. A. The City Council shall establish by Resolution the fees,rates and charges for vehicle parking at all off-street City pay parking lots. Collection of such fees, rates, and charges shall be made through authorized payment methods including mobile payment applications, digital platforms,parking meters, attendants,orother_City-approved systems._Parking meters or attendants may collect the fees,rates,and charges. B. No person shall park or leave standing any vehicle upon any off-street City pay parking lot at any time without payment of the fees,rates and charges established for the use of the lot of Resolution of the City Council. C. All fees,rates and charges for parking at any off-street City pay parking lot shall be paid in advance in money of the United States of America, except as otherwise provided by validation agreement. D. No person shall park or leave standing any vehicle in violation of any properly noticed curfew as established by the City Manager of the Director of Community&Library Services. 10.50.030 Validation Agreement--Authorization A. The City Manager or the Director of Community &Library Services may enter into written agreements with any person or legal entity to provide for validation of parking in any off-street City pay parking lot. 428 B. The charges such person or legal entity pays shall be in accordance with the schedule of fees,rates and charges for non-validated parking established by Resolution of the City Council. 10.56.030 Parking Revenues from Metered Zones Collection of Coins From Meters It shall be the duty of the Director of Finance to designate some person or persons to make regular collections of the money deposited in parking meters, and to deliver the money to the Director of Finance. The City Treasurer may designate an employee to receive and account for all parking revenues. 10.56.040 Parking Revenues Coins Placed in Meter Fund. It is the duty of the Director of Finance City Treasurer to account for and process all on-street parking meter zone money and to deliver the money to the City Treasurer who shall place it in a special fund to be known as the"parking meter fund,"which shall be used exclusively for the purposes specified in Section 10.56.060 10.56.060 Use of Proceeds. The money paid to parking meters in the on-street parking meter zones is levied and assessed as a fee to provide for the proper regulation, control and inspection of traffic upon the public streets, and to cover the cost of supervising,regulating and inspecting the parking of vehicles in the zones,the cost of placing and maintaining lines or markings, designating parking spaces in the zones,the cost of the purchase, supervision,protection, inspection, installation,operation,maintenance, control and use of the parking payment collection devices and/or payment instruction signs meters installed hereunder,and the acquisitions by purchase or lease,improvement,operation,maintenance,repair and replacement of all parking facilities on streets; and the special fund in which such fees shall be devoted exclusively to those purposes. 10.56.080 Records of Violations The Police Chief shall keep an account of and report the number of each parking meter which indicates that the vehicle occupying the parking space adjacent to such parking meter is or has been parked in violation of any of the provisions of this chapter; the date and hour of such violation, the make and state license number of such vehicle, and any other facts a knowledge of which is necessary to a thorough understanding of the eireumstances attending such violation: The Police Depaitinent shall maintain records of all violations of any provision of this chapter occurring within designated on-street parking meter zones, including the date and time of each violation,the make and state license number of the vehicle involved, and any other information necessary to provide a complete understanding of the circumstances surrounding such violation, 10.60.020 Times and Coins or Payment Deposited Prescribed. The parking time and fees will be affixed to the parking meters, as follows: The parking time limits and fees for designated on-street parkins meter zones shall be established as follows: A. Business Zones. Parking spaces meters with 120-minute parking limits may 429 be installed in the business zones, in locations determined by the Director of Community &Library Services. The fee for parking shall be three dollars per hour in off-peak season and four dollars per hour in peak season. Exceptions to those rates shall include July 4th,the two days immediately preceding and/or following July 4th as selected by the Director of Community&Library Services, and the three days of the Air Show when rates will increase by two dollars per hour. 1. Parking spaces meters with 24-minute limits may be installed in the business zone in locations determined by the Director of Community& Library Services. Parking in these parking locations will be limited to 56:00 a.m. to 12:00 a.m. daily,including Saturdays, Sundays and holidays. 2. The Director of Community&Library Services may determine that certain business recreational zone parking hours may be limited or extended. Notice of limited or extended parking limits shall be posted for the public. B. Residential Zones 1. Parking spaces meters with 60-minute, 120-minute and 12-hour parking limits may be installed in the residential zones in locations determined by the Director of Community and Library Services. With the exception of Residential Zones(Section 10.60.010(B)(7)and(B)(8)),the fee for parking shall be three dollars per hour in off-peak season and four dollars per hour in peak season. The fee for parking in Residential Zones (Section 10.60.010(B)(7) and (B)(8)) shall be three dollars per hour in off-peak season and three dollars and fifty cents per hour in peak season. Exceptions to these rates shall include July 4th,the two days immediately preceding and/or following July 4th as selected by the Director of Community and Library Services and the three days of the Air Show when rates will increase by two dollars per hour. 2. Parking spaces meters with 60-minute, 120-minute, and 12-hour parking limits may be installed within the residential zone in locations to be determined by the Director of Community and Library Services. These parking locations will be limited to 5&00 a.m. through 12:00 a.m. daily, including Saturdays, Sundays, and holidays. C. Recreational Zones 1. Parking spaces meters with 12-hour parking limits may be installed within Zones A,B,C, D and E in locations determined by the Director of Community and Library Services. The fee for parking shall be three dollars per hour in off-peak season and three dollars and fifty cents per hour in peak season. Exceptions to these rates shall include July 4th,the two days immediately preceding and/or following July 4th as selected by the Director of Community and Library Services and the three days of the Air Show when 430 rates will increase by two dollars per hour. 2. Parking spaces meters or pay stations with 30-minute, 60-minute, 120- minute, and 12-hour parking limits may be installed within recreational zones in locations to be determined by the Director of Community and Library Services. These locations will be limited to parking from 56:00 a.m. through 12:00 a.m. daily, including Saturdays, Sundays,and holidays. 3. The Director of Community and Library Services may determine that certain recreational zone parking hours may be limited or extended.Notice of limited or extended parking limits shall be posted for the public. 10.60.030 Varied Meter Time Limits. When the City Council designates the parking times allowed following payment as provided in this chapter and more than one parking time is so designated,the Director of Community and Library Services may place the meters in such locations within the zone as he or she shall deem proper and consistent with the intention of the City Council. The Director of Community and Library Services or designee may designate the parking times Mowed following payment as provided in this chapter. Parkins payment devices or systems shall be configured to correspond to the designated time limits for each space. 10.60.040 State Highways Within Zones. The provisions of Chapters 10.56, 10.60, 10.64 and 10.68 of the Huntington Beach Municipal Code shall be ineffective as to any portion of a state highway within the boundary of the on-street parking meter zone as set forth in Section 10.60.030 six months after receipt of notification from the Department of Transportation of the State of California of its rescinding its approval to the ordinance codified in this chapter. 10.60.050 Curfew. In all on-street parking meter zones,the payment of fees through any authorized parking payment device or system to a parking meter or pay station does not exempt a person or vehicle from receiving a citation for violation of the posted curfew. 10.64.010 Parking Payment Parking Meters When directed by the City Council,the Director of Community Services shall cause to be installed upon such streets or portions thereof within the on street parking meter zones, adjacent to each designated parking space, such parking meters as shall have been approved by the Council. When directed by the City Council the Director of Community and Library Services shall cause to be installed on such streets or portions thereof within designated metered zones, parking payment devices or systems. { 10.64.020 Signs Indicating Payment Requirement Meter Type It is the duty of the Department of Public Works to maintain signs in the various areas within the parking meter zones, indicating the type of meter there installed and the 431 days and hours during which the parking meters are in operation. The Department of Public Works shall install and maintain signs in the various areas within metered parking zones. The signs shall clearly indicate the type of parking payment device or payment system available and the days and hours during which payment is required. 10.64.030 Sign Location Signs as mentioned in Section 10.64.020,may either be on separate posts, painted on the curbs,or fastened to the parking meters, in the discretion of the Department of Public Works. Signs as referenced in Section 10.64.020 may be placed on separate posts,painted on curbs, displayed electronically,or otherwise provided in a reasonable manner to inform the public,at the discretion of the Department of Community and Library Services. 10.64.040 Markings Indicating Parking Meter Space. The Department of Public Works shall have lines or markings painted upon the curbs, streets or area adjacent to each parking meter, designating the parking space for which the meter is to be used. The Department of Public Works shall have lines or markings painted or otherwise placed on curbs, streets, or adjacent areas to designate each wing space within designated metered zones and its applicable payment requirements. 10.64.050 Vehicle Position Within Lines. Each vehicle parked adjacent to any parking meter shall be parked within said lines or markings. Each vehicle parked in a designated g space shall he positioned entirely within the lines or markings defining that space. 10.64.070 Proper Functioning. Each parking meter shall be so designed that the deposit of a coin or coins will set the mechanism of the meter in motion or permit the mechanism to be set in motion so that the meter will show the unexpired parking time applicable to the parking space adjacent to the meter; and the meter, when parking time has expired, shall so indicate by a visible sign. Parking payment devices or systems shall be designed to register payment for authorized.parking time and provide a reasonable means of verifyinthat payment has been made, and the applicable parking time has not expired Parking rates not specified in this Title shall be established by City Council resolution. 10.64.080 Adjusting Meters, Parking meters when installed and properly operated shall be so adjusted to accept coins to show legal parking time. Rates will be determined by Council resolution. 10.68.010 Payment Coin Deposit Required. No person shall park any vehicle in any parking space(except as otherwise • 432 permitted in this chapter) without immediately making payment through an authorized parking payment device or system in the amount and for the time period required for that space.depositing in the parking meter adjacent, or centrally located,to said space such lawful coin or coins of the United States as are required by such meter and designated by directions on the meter, and when required by directions OR the meter, setting in operation the timing mechanism thereof(if applicable),in accordance with said directions,unless the parking meter indicates at the time such vehicle is parked that an unexpired portion remains of the period for which a coin or coins have been previously deposited. 10.68.020 Overtime Parking—On-Street Parking Meter Zones Business Zones. No person, except as otherwise provided in this Cehapter, shall cause,permit, allow or suffer any vehicle registered to or parked or operated by him or her to be or remain parked in any parking space in an on-street parking meter zone,designated by resolution of the City Council as a business zone,during any time when the parking meter adjacent to such parking space indicates that no portion remains of the period of time for which a coin or coins have been deposited,beyond the time parking in such place is otherwise permitted or limited, or without paying the posted fee for the entire time the vehicle occupies the parking,space. 10.68.030 Overtime Parking Residential Zones No person,except as otherwise provided in this chapter, shall cause,permit, allow or suffer any vehicle registered to or parked or operated by him or her to be or remain parked in any parking space in a parking meter zone, designated by any resolution of the City Council as a residential zone,during any time when the parking meter adjacent to such parking space indicates that no portion remains-of the period of time for which a coin or coins have been deposited,beyond the time parking in such place is otherwise permitted or limited,or without paying the posted fee. 10.68.040 Overtime Parking Recreational Zones No person, except as otherwise provided in this chapter, shall cause,permit,allow or suffer any vehicle registered to or parked or operated by him or her to be or remain parked in any parking space in a parking meter zone, designated by resolution of the City Council as a recreational zone,during any time when the parking meter adjacent to such parking space indicates that no portion remains of the period of time for which a coin or coins have been deposited,beyond the time parking in such place is otherwise permitted or limited, or without paying the posted fee. 10.68.050 Payment Required Coin Deposit-- Exception A vehicle may be parked and remain parked in a parking meter space without the deposit of any coin in the parking meter adjacent thereto during hours other than those designated by resolution of the City Council as hours during which such deposits are required. A vehicle may be parked in a metered zone without payment during hours as authorized by City Council Resolution or Minute Action. 433 10.68.060 Slugs It is unlawful to deposit or cause to be deposited in any parking meter any slug, device or metallic substitute for a one cent or a five cent era 25 cent coin of the United States. 10.68.070 Tampering with Signs, Payment Devices,or Meters. It is unlawful for any unauthorized person to open, or for any person to deface, injure, tamper with, or willfully break, destroy or impair the usefulness of any parking meter or sign,or to attempt to circumvent any authorized parking payment device or system, installed pursuant to this chapter, or to hitch any animals thereto. 10.68.080 Parking Permits. Not withstanding any other provision of this Code,there is established a system of permit parking subject to the following standards and provision: A. A nontransferable parking permit shall be issued after payment of a fee, set by resolution of the City Council,to cover a calendar year. Such parking permit or decal,when affixed to the front windshield of a vehicle within a seven inch square in the lower corner farthest removed from the driver's position, shall authorize the parking of said vehicle in posted or metered recreational parking areas in the City, as such recreational parking areas have been, or may be hereinafter,established by resolution of the City Council,without the deposit of coins in a parking meter adjacent to a metered parking space. Such parking permit shall not,however, establish any priority for a parking space. A. A non-transferable parking permit shall be issued upon payment of a fee established by resolution of the City Council and shall be valid for a period of one year. Such permit m.y be issued in the form of a p ysical decal or a virtual permit associated with a vehicle's license plate number. When a physical decal is issued,it shall be affixed to the inside of the front windshield of the permitted vehicle within a seven-inch square in the lower corner farthest removed from the driver's position. A virtual permit shall be valid only for the vehicle wkose license Mate number is registered with the City's parking permit system. A valid parking permit shall authorize the parking of the permitted vehicle in posted or metered zone areas within the City,as such areas have been or may hereafter be established by resolution of the City Council,without payment otherwise required for parking within such areas. Issuance of a parking permit shall not establish any priority or guarantee the availability of a parking space. B. Parking permits or decals shall be issued for one vehicle only and shall not be transferable to any other person or vehicle except in those cases where the vehicle for which the permit has been issued has been disposed of and a substitute vehicle acquired. Such permit shall be transferable to such substitute vehicle upon presentation of the old permit together with a transfer fee of one dollar. B. Section 13.08.010 of the Huntington Beach Municipal Code is hereby amended to read as follows: 13.08.005. Definitions. For the purposes of this chapter, the following terms shall have the respective meanings set forth herein, unless the context in which they are used clearly indicates to the contrary: "Adjacent Beach Area" includes that strip of land owned and/or operated by the City of Huntington Beach, south of Anderson St.,lying between Pacific Coast Highway and the mean high tide line of the Pacific Ocean. "Beach" also includes that portion of the State Beach (Bolsa Chica) which the City operates pursuant to an operating agreement with the State of California. The "Adjacent Beach Area" includes the Beach Service Road,the Pier,the Pier Plaza,walkways, guardrails, hills, raised banks, structures and Beach Parking Lots. The "Adjacent Beach Area" extends from the mean high tide line of the Pacific Ocean to the west curb line of Pacific Coast Highway from Warner Avenue to the Santa Ana River and the mean high tide line of the Pacific Ocean to the west residential property lines of South Pacific Avenue from Warner Avenue to Anderson Street. Unless otherwise specifically referenced,this definition shall only apply to this section of the Huntington Beach Municipal Code. "Alcoholic beverage" includes alcohol, spirits, liquor, wine, beer and every liquid or solid containing alcohol,spirits,wine or beer and which contains one-half of one percent or more of alcohol by volume and which is fit for beverage purposes either alone or when diluted, mixed, or combined with other substances. "Beach" includes that strip of land owned and/or operated by the City of Huntington Beach, south of Warner Avenue, lying between Pacific Coast Highway and the mean high tide line of the Pacific Ocean. "Beach" also includes that portion of the State Beach (Bolsa Chica) which the City operates pursuant to an operating agreement with the State of California. "Beach" also includes that strip of land owned, controlled and/or operated by the City of Huntington Beach lying from and including Anderson Street to the north, Warner Avenue to the south, the mean high tide line of the Pacific Ocean and the west legal property line of adjoining residential properties which are on South Pacific Avenue, excluding the street appendages that extend west of South Pacific Avenue. "Beach Parking Lot" means roads,driveways or parking area to service the Beach,Pier or Pier Plaza, excluding those areas located on a street or highway. "Beach Service Road" means the paved roadway on the Beach that extends from Beach Boulevard to Sea Point Avenue running parallel to Pacific Coast Highway nearest to the shoreline of the Pacific Ocean. 1 436 ORDINANCE NO. 4351 "Director" refers to the Director of the Community and Library Services Department and/or his or her designee. "Emergency Services Access Zone" includes the Beach Service Road, the driveway between lifeguard headquarters and the service road, all public stairways, sidewalks, walkways, pedestrian access ramps, the area of Pier Plaza located between prolongation lines from the outermost edges of the Municipal Pier, a 14-foot wide pathway, seven feet to each side of the centerline of the Municipal Pier's deck;the area directly in front of any operational lifeguard tower to the waterline, and any areas, lanes or zones on the Beach delineated by signs or barriers, including temporary measures, to permit unobstructed access by emergency vehicles and emergency service personnel. "Facilities" include bonfire rings, buildings, parking lots, picnic tables, barbecues, courts, and lifeguard towers. "Occupied" means used for the purpose of protecting human beings from wind,sun, rain or public view. "Pacific Ocean" includes all waters of the Pacific Ocean to a point three miles out from the mean high tide line,parallel to the three miles out from the Beach whether or not the lands lying under said tidal waters are privately owned or publicly owned, including, but not limited to,the Water Activity Zone. "Person" means any individual, firm, copartnership, joint venture, association, social club, fraternal organization, corporation or any other group or combination, acting as a unit. "Pier" means the appurtenance beginning at the intersection of Pacific Coast Highway and Main Street on the Beach, which is a platform extending into the Pacific Ocean and supported by piles or pillars. "Pier Plaza" means the developed area on the Beach immediately north and south adjacent to the Pier bounded by Pacific Coast Highway and the Beach Parking Lots adjacent thereto. "Smoke" or "smoking" means the carrying or holding of a lighted pipe, cigar, cigarette, e-cigarette, or any other lighted smoking product or equipment used to burn any tobacco products, weed, plant, or any other combustible substance. Smoking includes emitting or exhaling the fumes of any pipe, cigar,cigarette, e-cigarette or any other lighted smoking equipment used for burning or vaporizing any tobacco or nicotine product,weed, plant, or any other combustible substance. "Water Activity Zone" means the area that extends 1,000 feet seaward into the Pacific Ocean from the mean high tide line. "Wheeled conveyance" shall include, but not be limited to, automobiles, bicycles, skateboards, rollerblades, rollerskates, and strollers. 2 26-17889/410982 437 ORDINANCE NO. 4351 SECTION 2. No Person shall give, set up or maintain any exhibition, show performance, concert, lecture,entertainment or similar activity on the Beach or Adjacent Beach Area without written permission to do so from the Director; No person shall provide,offer,or advertise any:service; nor rent, lease, furnish, or otherwise make available any furniture, equipment, apparatus,or similar personal property for commercial or promotional purposes on the Beach or in the Adjacent Beach Area, including reservations of City owned facilities,without a permit issued by the Director. No Person shall,whether for donation, fee, compensation or other consideration, conduct, offer,advertise sports camps,sports lessons, athletic instruction, group fitness activity or other similar activity on the Beach,Adjacent Beach Area,or in the Water Activity Zone without the written permission of the Director. "Beach Parking Lot"means roads,driveways or parking area to service the Beach, Pier or Pier Plaza,excluding those areas located on a street or highway. "Beach Service Road" means the paved roadway on the Beach that extends from Beach Boulevard to Sea Point Avenue running parallel to Pacific Coast Highway nearest to the shoreline of the Pacific Ocean. "Director"refers to the Director of the Community and Library Services Department and/or his or her designee. "Emergency Services Access Zone" includes the Beach Service Road,the driveway between lifeguard headquarters and the service road,all public stairways,sidewalks, walkways,pedestrian access ramps,the area of Pier Plaza located between prolongation lines from the outermost edges of the Municipal Pier,a 14-foot wide pathway,seven feet to each side 439 of the centerline of the Municipal Pier's deck;the area directly in front of any operational lifeguard tower to the waterline, and any areas,lanes or zones on the Beach delineated by signs or barriers,including temporary measures,to permit unobstructed access by emergency vehicles and emergency service personnel. "Facilities"include bonf re rings,buildings,parking lots,picnic tables,barbecues, courts,and lifeguard towers. "Occupied"means used for the purpose of protecting human beings from wind, sun,rain or public view. "Pacific Ocean" includes all waters of the Pacific Ocean to a point three miles out from the mean high tide line,parallel to the three miles out from the Beach whether or not the lands lying under said tidal waters are privately owned or publicly owned,including, but not limited to,the Water Activity Zone. "Person" means any individual,firm,copartnership,joint venture,association, social club,fraternal organization,corporation or any other group or combination,acting as a unit. "Pier" means the appurtenance beginning at the intersection of Pacific Coast Highway and Main Street on the Beach,which is a platform extending into the Pacific Ocean and supported by piles or pillars. " Pier Plaza"means the developed area on the Beach immediately north and south adjacent to the Pier bounded by Pacific Coast Highway and the Beach Parking Lots adjacent thereto. "Smoke"or"smoking"means the carrying or holding of a lighted pipe,cigar, cigarette,e-cigarette,or any other lighted smoking product or equipment used to burn any tobacco products,weed,plant,or any other combustible substance. Smoking includes emitting or exhaling the fumes of any pipe,cigar,cigarette,e-cigarette or any other lighted smoking equipment used for burning or vaporizing any tobacco or nicotine product,weed,plant, or any other combustible substance. "Water Activity Zone"means the area that extends 1,000 feet seaward into the Pacific Ocean from the mean high tide line.
